Woman, daughter injured in horrific Pa. Turnpike crash last year file lawsuit

PITTSBURGH — A woman and her 11-year-old daughter have filed a lawsuit against a tour bus operator, FedEx and a FedEx driver, after they were both injured in a horrific crash on the Pennsylvania Turnpike.

According to our partners at TribLive.com, Cheng Ying Lian, 39, and her daughter, Ivy Ou, are the plaintiffs in the lawsuit. It alleges the bus company, Z&D Tours, Inc.; FedEx Ground Package System Inc.; and Brandon Stowers, the FedEx driver were negligent.

Lian suffered traumatic brain injury along with severe physical and emotional injuries, according to the suit filed in U.S. District Court.

Five people, including a child, were killed and roughly 60 people were taken to area hospitals with injuries after three tractor-trailers, the tour bus and a car collided at about 3:30 a.m. on Jan. 5.

Officials with the National Transportation Safety Board said after the tour bus had passed a FedEx truck, the bus driver lost control, struck the center barrier on the highway and then veered to the right back across the road. The bus then went up a steep embankment and rolled back onto the highway. The FedEx truck then collided with the bus. Seconds later, two UPS tractor-trailers and a car then hit the overturned bus.

The speed limit in the area where the crash happened, mile marker 86.1, is marked as 70 mph. A preliminary NTSB report said light snow was falling in the area, but the road had been treated. It’s not clear how fast the bus was traveling at the time of the crash. State police were able to remove the Engine Control Module from the bus in the hope of downloading that information.

The lawsuit filed by Lian seeks $10 million in damages for her and $5 million for her daughter.

Two brothers from New Jersey who were also passengers on the bus filed a lawsuit against Z&D Tours in March.
