NORTH VERSAILLES, Pa. — A local woman just won a lawsuit against Kmart over the tax that was added to her toilet paper purchases.
This is the fourth time Mary Bach has sued the company over this issue and won.
She said it is a problem at Kmarts across the state.
“If they're doing business in Pennsylvania, they have to follow our laws,” Bach said.

She filed against Kmart in small claims court after she said she was wrongly charged sales tax on toilet paper.
In Pennsylvania, toilet tissue is a non-taxed item.
Bach told Channel 11 she bought the toilet paper at the North Versailles store, and even gave them a chance to fix the error.
Bach said, “I actually told the cashier at the store. I went back and bought it subsequently. They were still doing it. I told them again. They did not fix it."
She then made the same purchase at Kmart stores in Easton, York, Harrisburg, Carlisle and Shamokin Dam, and each time had the same result.
“I actually sued successfully in 2007 on this same issue and won. I sued them twice on the toilet tissue issue in 2009 and won both of those cases.”
Bach said her case should be a lesson to all consumers.
“I want people to look at their register receipts,” Bach said. “I want them to know what's taxable in Pennsylvania and not and if they find an error to speak up loudly.”
Bach successfully won her case in small claims court Tuesday and was awarded $100, plus court costs.
