Man sues restaurant for overserving him alcohol, awarded $5.5 million

A Texas man filed a civil suit against a restaurant and bar claiming they over-served alcohol, him causing him to get into an argument with another customer in which he got hurt.

Daniel Rawls sued La Fogata Mexican Grill earlier this year for an incident that happened in 2019, the Midland Reporter-Telegram reported.

Rawls said the restaurant, its owner and bartender were responsible for his and another man’s excessive drinking. The suit said the restaurant allowed the pair to leave together. The two men subsequently got in an argument where Rawls said he got hurt.

Rawls filed five claims against La Fogata, the owner and an unidentified bartender, including premises liability, negligence and damages.

The suit claims that the bartender was not trained to notice when patrons had too much and that the owner didn’t make sure the parking lot was free of tripping or falling hazards.

The Andrews County 109th District Court ruled for Rawls on July 27 in a default judgment since the owner did not respond to the suit or attend the court hearing. The court’s ruling awarded $5.5 million to Rawls, but didn’t say if the claims were true, the Reporter-Telegram reported.

The defendants have 30 days to file an appeals notice if they want a new trial.
